Warehouse worker reports safety violations to OSHA, only to then get written up for having an "attitude" problem: 'They make you the problem instead of actually fixing the problem'

    Reported that our warehouse doesn't meet OSHA standards broken equipment, blocked exits, the whole thing. Told my manager it's a liability. He said he'd "look into it."
  • Week later I get called into his office. Apparently I have an "attitude problem" and need to be a "team player." The write-up is in my file now.
  • Safety violations are still there. Equipment still broken. But now if I say anything else, they can point to the write up and say I'm just being difficult.

  • This is how they do it. They make you the problem instead of fixing the actual problem. Now I'm job hunting because I'm not risking my life so the company can save on maintenance.

  • • I... • 22h ago Edited 22h ago Just wanna say this is the way they do it, but you see OSHA violations and instead of telling OSHA you tell...management? Did you think they don't know they are violating OSHA? You walked in and put a target on your back. Luckily you have some plays left:

  • If you did report to OSHA then it could be reasonable that this is retaliation and will continue until you are let go. 2 things:
  • 1. REPORT TO OSHA (if you haven't) 2. consult your EE handbook to find what the writeup policy is. For example the handbook may say you get a verbal warning
  • before being written up. If you didn't get that write an email to HR or the person who wrote you up or both... quote the policy and ask why it's not being followed in your situation. Bcc your personal email.

  • If you are in a job where company email isn't an option find out if it is legal to record audio without the other party being made
  • aware. If legal record the convo. If this person you interact with is as dumb as they sound they will write you up again or term you on the spot.
  • As long as you contact OSHA before going forward you will have a great case for ER retaliation or at least hostile work environment which might help you get UI benefits.

  • Bonus: contact fire Marshall on the blocked exits or non emergency fire services to report or ask how you can report. Fire safety will swiftly be addressed most likely.
